Judges warn of escalation: Unblock salaries and enforce Constitutional Court ruling

The dispute over salaries in the justice system has entered a harsher phase. After an extraordinary meeting, judges came out with a unified position: salaries must be unblocked immediately and the Constitutional Court’s ruling must be enforced without delay, while any administrative obstacle is being viewed by them as a direct challenge to the constitutional order.

A direct demand to institutions

The General Assembly of Judges addressed the responsible institutions and the President of the Republic with a request to put an end to the blocking of salaries for judges and the judicial administration.

In the statement adopted at the end of the meeting, the judges demand the full implementation of Constitutional Court decision No. 15/2026, as well as decision No. 435, dated August 26, 2026, of the High Judicial Council. They insist that these acts are binding and cannot be neutralized through inaction, financial interpretation or administrative acts.

The blocking of payments at the center of the accusations

According to the judges’ position, the situation is not simply a debate over funds, but an issue that affects the independence of the judicial branch and the authority of Constitutional Court decisions.

They argue that after July 31, 2026, the application of the formula declared unconstitutional cannot continue, and that the lack of action by the legislature does not justify the suspension of constitutional guarantees for judges’ pay.

In particular, the statement also targets the role of the Treasury, which, it is claimed, has no authority to exercise constitutional or judicial review over the acts it is required to execute.

Court administration also affected

The judges’ position is not limited only to the salaries of magistrates. The statement emphasizes that the blockage has also affected court secretaries, chancellors, clerks and other court employees.

According to this position, leaving the judicial administration unpaid harms not only the living conditions of employees, but also the daily functioning of the courts and, ultimately, the very service provided to citizens.

Warning: court activity may be restricted

The strongest point of the statement is linked to the measures being warned of if institutions do not react immediately. The judges say their response will escalate to the reduction and temporary restriction of judicial activity.

According to their decision, in such a scenario only urgent cases and those requiring immediate judicial intervention would be reviewed. At the same time, they also warn of the use of administrative, civil and constitutional means to compel the execution of payrolls.

Call to the President and pressure on the government

The statement calls on the President of the Republic to engage in safeguarding the independence of the judicial branch and to closely monitor the legal changes being discussed in Parliament.

The judges also call on Parliament, the Council of Ministers, the Ministry of Finance and other responsible institutions to immediately stop this situation. According to them, the continuation of the blockage can no longer be presented as technical ambiguity, but as a conscious stance that undermines the Constitutional Court’s ruling and the functioning of the rule of law.

At the end of their position, the judges sum up the conflict in a blunt formula: the final decision is not suspended, the legal obligation cannot be held hostage, and salaries must be transferred immediately.

In the face of this public pressure from the justice system itself, the burden of explanation remains on the financial and political institutions that have so far failed to resolve the deadlock.
