The process of selecting candidates for the post of Prosecutor General has shifted from screening names to a clash within the High Prosecutorial Council itself. Instead of a clear and credible procedure, the latest KLP meeting is taking place under the shadow of a chain of recusal requests among members and participants in the process.
A meeting marked by procedural tensions
The KLP met again this Wednesday, while several recusal requests have been submitted to members, further complicating the procedure for selecting candidates for Prosecutor General.
The situation has highlighted not only the tension within the institution, but also the weakness of a process that is supposed to guarantee impartiality and high standards of decision-making.
How the chain of requests began
The clash began at the previous meeting, when candidate Ylli Pjeternikaj requested the recusal of Vat Staka from the procedure.
After that, the requests continued one after another: Vat Staka requested the recusal of Zeqir Hoda, Hoda requested the recusal of Sokol Stojani, while Stojani requested the recusal of KLP chair Mirela Bogdani.
Claims against the KLP chair
In his request, Sokol Stojani raised claims regarding the impartiality of chair Mirela Bogdani.
According to the submitted request, he asks that Bogdani not take part in directing, reviewing, discussing, and voting on the recusal requests.
A process under question
Under these conditions, today’s meeting is taking place amid a series of mutual recusals: Pjeternikaj against Staka, Staka against Hoda, Hoda against Stojani, and Stojani against Bogdani.
This unusual scheme has turned an important race for the leadership of the prosecution body into a process filled with procedural disputes, increasing doubts about the way the competition is being administered.
For the moment, the issue no longer appears to be only about vetting candidates, but as a test of the KLP’s own ability to administer a sensitive procedure without entering into open conflict inside the decision-making chamber.
The more recusal requests increase, the harder it becomes to convince public opinion that the race for Prosecutor General is proceeding under an unquestionable standard of impartiality.
