Another institutional clash is moving to the Constitutional Court. PDK has submitted a request to verify the constitutionality of the decisions and procedures related to the constitution of the 11th Legislature of the Assembly of Kosovo, while also seeking a halt to further steps until a final decision is made.
The request was submitted by parliamentary group leaders
The request was submitted by PDK Parliamentary Group leader Arian Tahiri, MP Përparim Gruda, and lawyer Faton Fetahu.
According to the version presented by PDK, there were violations of the constitutional order during the process of constituting the Assembly, and the party is therefore asking the Constitutional Court to give the final interpretation on the legality of the procedures that were followed.
PDK challenges the way the process unfolded
Arian Tahiri said the issue had been taken to the Constitutional Court following the latest developments in the Assembly, arguing that interpretation of the Constitution cannot be left in the hands of political calculations.
MP Përparim Gruda also said the aim of the request is to restore institutional functioning in line with the Constitution. In essence, PDK is challenging the way the process was carried out and is asking for constitutional rules to be applied equally to all political entities.
A temporary suspensive measure is also being sought
In addition to the main request, PDK has also asked the Constitutional Court to impose an immediate temporary measure.
According to lawyer Faton Fetahu, the measure is intended to avoid further legal and institutional consequences until the court issues its ruling. In essence, the request seeks to ensure that no new institutional steps are taken during this period that could further affect the already contested situation.
Which decisions are being challenged
The request challenges several key acts adopted during the process of constituting the Assembly of Kosovo.
These include the September 9, 2026 decision on the election of the Assembly speaker, the procedural decision of September 11, 2026 on the method of voting for deputy speakers, and the September 13, 2026 finding on the constitution of the 11th Legislature.
PDK is asking the Constitutional Court to examine whether these decisions and procedures are in line with the Constitution and, if violations are identified, to determine the legal consequences arising from them.
Another case concerning the Government is also announced
At the same time, PDK said it will submit another case to the Constitutional Court on Wednesday, this time related to the formation of the Government of Kosovo.
The move shows that the political battle is not being fought only in the Assembly chamber, but is also passing through constitutional scrutiny, where it will be tested whether the procedures followed were merely politically debatable or also legally problematic.
The Constitutional Court’s decision is expected to be decisive not only for the validity of the steps taken so far, but also for the limits within which the institutional process in Kosovo can move forward.
